NSSF Heads To Court Over Temangalo Land

The National Social Security Fund (NSSF) is seeking a High Court order to take full possession of 55 acres of land at Temangalo in Wakiso District, ending a dispute that has dragged on for more than a decade.

NSSF bought 463.87 acres from Arma Limited and Amos Nzevi in 2008. The land is covered by six titles, all registered in the Fund’s name.

As part of the 2008 deal, Nzevi was allowed to retain 104.88 acres, including a farmhouse and paddocks, on condition that he provided NSSF with suitable alternative land within six months. The alternative land provided did not meet the agreed conditions, leading to a dispute over the 104.88 acres.

The two sides tried to resolve the matter in 2011 before agreeing in 2013 to take the dispute to arbitration. The arbitration award maintained that Nzevi was required to provide land of equal and suitable value, adjacent to NSSF’s existing property, suitable for housing developments and free of squatters.

NSSF says two independent valuations carried out since then found that only 10 acres of the alternative land offered by Nzevi met the requirements. In June this year, NSSF gave Nzevi until June 30 to provide suitable alternative land, warning that it would take legal action if he failed to comply.

The deadline has since passed, prompting NSSF to begin the process of asking the High Court to enforce the land-swap terms and secure possession of the 55 acres, which forms part of the land purchased and registered in the Fund’s name in 2008.

NSSF says the court action is intended to protect its ownership rights and the interests of its members.
